O R D E R

The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 5(I), 5(n) r/w Section 6 of POCSO Act, in Crime No. 22 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2.The case of the prosecution is that the victim girl who is the daughter of the De-facto complainant's younger sister, was studying XII in a private school at Bhuvanagiri. The petitioner along with other accused A1, A3 & A4 had physical relationship with the victim girl who is aged about 16 years, on several occasions since 2021. Now, the victim girl got pregnant. Based on the complaint lodged by the sister of the de-facto complainant, the respondent police registered an FIR against the petitioner and other accused.

3. The learned counsel for the petitioner submits that the petitioner is a college student and he has been falsely implicated based on the confession statement of the co-accused. He also submits that the petitioner is ready to abide by any conditions that may be imposed by this Court and ready to furnish sufficient solvent sureties for his release. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal side) appearing for the respondent police, reiterated the prosecution case and submits that totally four accused involved in this case. He further submits that A1 2/6

to A4 had physical relationship with the victim girl who is aged about 16 years on several occasions since 2021. He further submits that 164 statement of the victim girl was recorded. He further submits that the petitioner/A2 has actively involved in penetrate sexual assault, he opposed for grant of anticipatory bail to the petitioner.

This Court has perused the FIR as well as the 164 statement of the victim girl who is aged about 16 years, it reveals that petitioner along with others is actively involved in the crime and considering the gravity of offence committed by the petitioner/A2; that custodial interrogation is very much required in this case and therefore, this Court is not inclined to allow this Criminal Original Petition.

6. Accordingly, this Criminal Original Petition is dismissed. 23.09.2025 MSM 3/6
