This petition has been filed seeking to condone the delay of 234 days in filing the above appeal.

2.Heard the learned counsel for the petitioner. He would aver that the original judgment was misplaced in petitioner's residence and was traced out later and by that time, a delay of 234 days occurred.

Hence, he prayed for condoning the delay in filing the appeal.

3.Mrs.R.Sreevidhya, learned counsel files vakalat for the 2nd respondent. She does not have any serious objection to allow this petition on condition that the interest for the delay period is waived.

4.Accepting the averments made in the affidavit filed in support of this petition, this petition is allowed subject to the condition that the interest for the delay period of 234 days shall stand waived.
