(made by M. SUNDAR, J.) When the captioned 'writ petition' [hereinafter 'WP' for the sake of brevity] was taken up for hearing, Mr. P. Sidharthan, learned counsel on record for writ petitioner, submitted that S.F.No.701/6A in ELGI Nagar Phase I, Vellalore Village, Coimbatore (South) Taluk, Coimbatore District, belongs to writ petitioner, whereas, it has been wrongly described as the land which is a vaikkal/pathway and as land which is under encroachment.

Owing to this narrative, instead of going through a cumbersome process of amendment, learned counsel on record for writ petitioner sought leave of this Court to withdraw the captioned WP but made a plea to preserve all the rights and contentions of the writ petitioner to come back to this Court on the same issue with correct description. Scanned reproduction of the endorsement made by learned counsel on record for writ petitioner in this regard in the case file is as follows:

In the light of the narrative thus far, captioned WP stands disposed of as closed/withdrawn, albeit with preservation of rights and contentions of writ petitioner in the aforesaid manner. There shall be no order as to costs.
