ORDER
The Writ Petition is filed for the below relief: " directing the respondents herein to implement the wage settlement and to re-calculate the retirement benefits of the petitioner such as difference amount of gratuity, leave salary, provident fund, commuted value of pension, pension arrears and other retirement benefits and to pay the same to the petitioner
along with interest at the rate of 6% per annum "
2. It is the petitioner's case that he had joined service in Annai Transport Corporation as a driver, from which Corporation he had attained the age of superannuation on 28.02.2018. At the time of retirement, he was holding the post of "Selection Grade Senior Driver". Though, the petitioner was paid retirement benefits like Provident Fund, Gratuity amount, leave encashment (Earned leave and Medical leave) belatedly under the pre revised pay, the difference amount under the above heads as per the Section 12(3) Settlement had not been paid. The petitioner had made representation to this Respondent which were however, ineffective. Therefore, the petitioners had moved this Court.
3. Considering the limited request of the petitioner and taking note of the fact that the petitioner's representation dated 03.07.2024 has not been considered to date by the Respondents, a mandamus, is therefore, issued to the Respondents to pass orders on the representation dated 03.07.2024 of the
petitioner which is been filed as Document No.2 in the typed set of papers within a period of one month from the date of receipt of copy of this order and to report compliance.
4. The Writ Petition is allowed. No costs.
