C.M.P.No.22832 of 2019 in C.M.A.Sr.No.121943 of 2019 R.SUBBIAH, J and T.KRISHNAVALLI, J This Petition has been filed to permit the petitioners to pay a sum of Rs.375/- as Court fee instead of Rs.25,375/- and exempt from payment of Rs.25,000/- as balance Court fee till the disposal of the above Appeal.
2. In the affidavit filed in support of this petition it is stated that the petitioners are the legal heirs of the deceased Sekar who succumbed to the injuries sustained in the road accident on 11.07.2015. On his death, the petitioners have filed M.C.O.P.No.2757 of 2015 before the Claims Tribunal and the Claims Tribunal ordered a sum of Rs.13,11,000/- (Rupees Thirteen Lakhs Eleven Thousand only) as compensation. Aggrieved by the same the present Appeal has been filed for enhancement of compensation.
3. It is the case of the petitioners that after the death of the bread winner they have left with no source of income and therefore they are unable the pay the Court fee payable for entertaining the Civil Miscellaneous Appeal. The petitioners are now ready and willing to pay a sum of Rs. 375/- as Court fee and also undertake to pay the balance sum of Rs.25,000/- immediately after disposal of the present Civil Miscellaneous Appeal.

4. Having regard to the above facts the petitioners are permitted to pay the Court fee of Rs.375/- instead of Rs.25,375/-. However, it is made clear that as and
R.SUBBIAH, J and T.KRISHNAVALLI, J when the Appeal is disposed of, the petitioners have to pay the balance Court fee payable by them.
