Respondents Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus to direct the first respondent to pass orders in proceedings No.Na.Ka.No.6660/2016/A3, dated 06.09.2016 within the time frame fixed by this Court.

ORDER

Heard the learned counsel for the petitioner and the learned counsel appearing for the respondents and with the consent on either side, the writ petition is taken up for final disposal.

2. This Writ Petition has been filed to direct the first respondent to pass orders in proceedings No.Na.Ka.No.6660/2016/A3, dated 06.09.2016 within the time frame fixed by this Court.

3. The case of the petitioner is that the petitioner is the absolute owner of the property situate at S.No.718/1A, 718/1D and 718/1D comprising a total extent of 3 acres 22 cents and https://hcservices.ecourts.gov.in/hcservices/

patta also stands in the name of the petitioner. Thereafter, in S.No.718/1B an area to an extent of 87 cents, fell to the share of the second respondent and the remaining area stood in the name of the petitioner. While so, the third respondent unlawfully got patta mutated in his name to an extent of 45 cents in S.No.718/1A. On receipt of the communication, the first respondent has commenced enquiry in Na.Ka.No.6660 of 2016/A3, but till date no order has been passed in the said proceedings. Hence, the petitioner has come forward with the present Writ Petition for early disposal of the said proceedings of the first respondent.

Considering the limited scope of the prayer sought for by the petitioner, this Court, without going into the merits of the claim of the petitioner petitioner, directs the first respondent to dispose of the proceedings in Na.Ka.En.6660/2016/A3 on merits and in accordance with law and pass orders as expeditiously as possible, preferably within a period of three months from the date of receipt of a copy of this Order.

The writ petition is disposed of accordingly. No costs.
