The petitioner/A1, who was arrested and remanded to judicial custody on 24.08.2023 for the offence punishable under Sections 8(c), 20(b)(ii)(B) of NDPS Act in Crime No.730 of 2023 on the file of the respondent police, seeks bail.
2. It is the case of the prosecution that the petitioner is an resident of Odisha State and he was found in possession of 5Kg of Ganga. Hence, the case was registered against the petitioner.
3.The specific case of the respondent that the petitioner is the supplier of Ganja and other three accused namely, A2, A3 and A4 were the sellers of Ganja. It is stated that the petitioner had handed over 5Kg of Ganja for such sale. Since the petitioner being the main accused, at this stage, this Court is not inclined to grant bail to the petitioner. Accordingly, this criminal original petition stands dismissed.
