Though the 2nd respondent remains unserved, the 1st respondent is the contesting respondent. The petitioner, who is the decree holder, seeks condonation of a delay of 130 days in preferring the first appeal against the fair and decreetal order, dated 12.12.2024 made in R.E.A.No.4 of 2024.

2. Heard the learned counsel for the petitioner.

3. The learned counsel for the first respondent has no serious objection to the petition being allowed.

4. I have independently gone through the affidavit filed in support of this petition, and I am satisfied that the petitioner has made out sufficient cause and accordingly, this Civil Miscellaneous Petition is ordered and post this matter on 09.02.2026.
