Writ Petition filed under Article 226 of the Constitution of India to issue the Writ of Mandamus to direct the first respondent to give an opportunity of hearing to the petitioner with respect to the erection of electricity transmission tower in the petitioner's land in S.No. 203/3 A in Boominayakanpatti, Pagalpatti Village.

Heard the learned counsel appearing for the petitioner and Mr.Abdul Saleem, learned Standing Counsel appearing for the Transmission Corporation/second respondent.

2. The case of the petitioner is that during the month of May 2019, the second respondent has entered into his agricultural lands without his knowledge and marked the places for erecting a power transmission tower. The petitioner herein https://hcservices.ecourts.gov.in/hcservices/

understand that, the high transmissions lines passes through his land and the second respondent is going to lay high tension tower in his land. Whereas, the learned counsel appearing for the second respondent submitted that the request to grant permission to enter upon has been made by the second respondent with the District Collector on 19.09.2019 and the petitioner may submit objection to the Collector, if he has any grievance over the tower transmission corridor passing through his land and only after the Collector grants permission, the respondent will carry out the project.

3. Recording the same, this writ petition is disposed of with a direction to the District Collector/first respondent herein to consider the application of the second respondent dated 19.09.2019 seeking permission to enter upon, in the light of the representation of the petitioner herein and pass orders in accordance with law within a period of four weeks from the date of receipt of a copy of this order.
