O R D E R

This petition has been filed to direct the respondent to register the FIR on the basis of the complaint lodged by the petitioner on 05.12.2015.

2. The petitioner has lodged a complaint as against one Gunasekar and 8 others stating that the petitioner is owner of a patta land situated at S.No.268/3, Sentharapatti Village, Gangavalli Taluk, Salem District. The counter petitioner, with an intention to grab the property, has brought a statute of deity and made an attempt to construct a temple in the said patta land. Hence, the petitioner lodged a complaint with the respondent police. Since no action has been taken so far, the present petition has been filed.

3. When the matter is taken up for consideration, learned Additional Public Prosecutor submitted that on receipt of the complaint from the petitioner, C.S.R.No.308/2015 has been assigned.

4. Since already CSR number was assigned on the complaint given by the petitioner, the respondent police is directed to conduct an enquiry and upon enquiry, if the materials are gathered indicating any cognizable offence, he is directed to proceed further in accordance with law as early as possible.

5. The criminal original petition is disposed of accordingly.
