Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the 1st respondent to cancel the T.S. Patta C.A. No.1752 / 13, TR No. 2540/2013 to classified in to Town Survey No. 28/1A1A/1A1 part issued in the name of 4th and 5th respondents on the basis of the representation dated 10.09.2019.

ORDER

This writ petition has been filed to issue a Writ of Mandamus, directing the 1st respondent to cancel the T.S. Patta C.A. No.1752 / 13, TR No. 2540/2013 to classified in to Town Survey No. 28/1A1A/1A1 part issued in the name of the 4th and 5th respondents on the basis of the representation dated 10.09.2019.

2. The petitioner submitted representation dated 10.09.2019 before the 1st to 3rd respondents to cancel the patta issued by the 2nd respondent in favour of the 4th and 5th respondents herein and to issue fresh patta in his favour and it is pending on the file of the 1st to 3rd respondents without passing any order.

3. Considering the above, the 1st respondent is directed to consider and dispose the representation of the petitioner dated 10.09.2019, after issuance of notice to the petitioner, 4th and 5th respondents herein and counter parties, if any and after giving opportunity of hearing to them, pass orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.

4. With the above direction, this writ petition is disposed of. No costs.
