By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

The present writ petition is filed praying for a writ of mandamus to direct the respondents 4, 5 & 6 to conduct an enquiry in the light of the letter dated 09.06.2025 issued by the 5th respondent in response to the legal notice dated 22.05.2025 issued by petitioners herein for issuance of patta in their favour with respect to the subject property.

It is submitted by the learned counsel for petitioners that petitioners issued a legal notice dated 22.05.2025 seeking to cancel the sub-division in respect of the property comprised in Survey No.34/3 measuring an extent of 05.08 acres, situated at Vengadamangalam Village, Chengalpattu Taluk and District. Pursuant to that, 5th respondent sent a letter dated 09.06.2025 directing the 6th respondent to conduct an enquiry and submit a detailed report. However, no action has been taken on the same till date. Hence the present Writ Petition.

At the outset, the learned Government Advocate would submit that the petitioners may have to submit an online application for issuance of patta, if an online application is submitted, respondents would consider the same and appropriate orders would be passed, within a time frame to be fixed by this Court, which was agreed to by learned counsel for petitioners.

In view of the limited relief that is prayed, this court is inclined to dispose of the writ petition with following directions: i) It is open to the petitioner to submit an online application before the respondents. If any such online application is filed by the petitioners, the concerned respondent shall consider the same and pass appropriate orders, after 3/6
issuing notice, conducting enquiry and affording a reasonable opportunity of hearing to petitioners and all other interested parties including rival claimants, if any, within a period of twelve (12) weeks from the date on which the online application is filed by petitioners.
ii) Though facts have been set out in affidavit, in view of the limited relief that is sought to be granted, I do not propose to examine the same, lest it may influence the authority. The authority shall independently consider the facts and law set out in the representation and pass appropriate order in accordance with law including but not limited to the provisions of the Tamil Nadu Patta Pass Book Act and Rules.
iii) It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the matter on its own merits and in accordance with law. Rights and contentions of the petitioners and all other interested parties are left open. 6.There will be no order as to cost.
