ORDER

This Criminal Original Petition has been filed to direct the respondent to file a final report in Crime No.41 of 2020 on the file of the respondent police.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Criminal Side) appearing for the respondent.

3. When the matter has been taken up for hearing, learned Government Advocate (Criminal Side) submitted that the investigation has been completed and a final report has been referred as "mistake of fact".

4. However, the learned counsel for the petitioner submitted that the notice referring the final report was not served on the petitioner.

5. When the final report has been referred as "mistake of fact", it is obligatory on the part of the respondent to serve the referred final report notice to the petitioner. Therefore, the respondent police is directed to serve

the referred final report notice to the petitioner within a period of one week from the date of receipt of a copy of this order.

6. With the above observations, this Criminal Original Petition is disposed.
