Crl.MP.No.13868 of 2019 in Crl.R.C.SR.No.46914 of 2019 Crl.MP.No.13868 of 2019 in Crl.R.C.SR.No.46914 of 2019 A.D.JAGADISH CHANDIRA, J., This petition has been filed to condone the delay of 1192 days for filing Crl.R.C.SR.No.46914 of 2019 against the order passed in C.A.No. 27 of 2015, on the file of the learned Principal Sessions Judge, Namakkal, dated 17.03.2016, against the petitioner.

The learned counsel appearing for the petitioner would submit that the petitioner is a bachelor and he has completed MBA. Since, he did not get any employment, he was working as a cleaner in Rig Unit and was roaming in Uttar Pradesh, Bihar and Rajasthan. Due to non employment, he became mentally depressed and thereby, he did not appear before the Trial Court and he was also not aware of the judgment of the learned Principal Sessions Judge dismissing the petitioner's appeal on 17.03.2016. The learned counsel would further submit that the relationship between him and his family members is not good and he would submit that he has also surrendered before the Trial Court and he is under confinement. Thereby, he seeks for condonation of delay. The learned counsel appearing for the respondent would submit that the respondent has filed counter affidavit and would oppose for condonation of delay. Heard both sides.

Having been satisfied with the reasons stated in the affidavit filed in support of this petition, delay is condoned.
