The petitioner, who was arrested and remanded to judicial custody on 23.07.2025 for the offences punishable under Sections 318(2) and 64 of Bharatiya Nyaya Sanhita, 2023 in Crime No.205 of 2025 on the file of the respondent police, seeks bail.
2. The petitioner was arrested on 23.07.2025 based on the complaint given by 'X' alleging that the petitioner had sexually intercourse with her by falsely promising to marry her, but failed to fulfil that promise. Hence, he committed the offence under Section 318(2) and 64 of BNS 2023. 3.The learned counsel appearing for the petitioner states that the petitioner and the defacto complainant were studying in the same college and they fell in love and had consensual sex. The petitioner never promised the defacto complainant that he would marry her. He also submitted that earlier there was a complaint at Killai Police Station, wherein there is no allegation of any sexual intercourse by deceit. Whereas, in the subsequent complaint to attract Section 64 of BNS 2023, a false fact has been added. 2/5
4. The learned Government Advocate (Crl.Side) states that the petitioner was subjected to a medical test and her statement was also recorded, as the investigation is on the verge of completion.
5. Taking note of the fact that the petitioner was arrested recently and till the investigation get completed and final report is filed, grant of bail will lead to distortion in the collection of evidence and in completion of investigation. Hence, this Criminal Original Petition stands dismissed for the present.
