PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus, to call for the records of the impugned order passed by the second respondent in Ka.No.99/E.Ni.Po./E&Pa/Na/Pa.Paa/Ni.Thi.Ma./Va.Aa/24-25, dated 03.09.2024, and quash the same, and consequently, directing the respondents 1 to 3 to restore the Electricity Service Connection No.279-003-733/IA.

O R D E R
This Writ Petition has been filed challenging the impugned order passed by the second respondent in Ka.No.99/E.Ni.Po./E&Pa/Na/Pa.Paa/Ni.Thi.Ma./Va.Aa/24-25, dated 03.09.2024 and for a direction to the respondents 1 to 3 to restore the Electricity Service Connection No.279-003-733/IA.
2. The learned counsel appearing for the petitioner submits that there is a civil dispute between the petitioner and the fourth respondent. All the house tax receipt, the property tax receipt, water tax receipt and the electricity bill stand in the name of the petitioner, however, the electricity service connection standing in the name of the petitioner was disconnected based on the representation given by the fourth respondent and therefore, the petitioner filed W.P.No.24823 of 2024 before this Court seeking for a direction to the respondents 1 to 3 herein to restore electricity service connection and it was disposed of on 19.06.2024 directing the second respondent herein to communicate a copy of the order for disconnection of electricity service and thereafter, the present impugned order daetd 03.09.
2024 has been issued to the petitioner, wherein, it has been stated that the electricity service connection was given only on 14.02.2020 and it has not been transferred to the name of any of the persons so far. Challenging the same, the present writ petition has been filed.
Court permits the petitioner to approach the civil Court.
3. Heard the learned counsel appearing for the petitioner, the learned counsel appearing for the first and second respondents and the learned Additional Government Pleader appearing for the third respondent.
4. Considering the limited request made by the learned counsel for the petitioner, this Court, without interfering with the impugned order dated 03.09.2024 issued by the second respondent, grants liberty to the petitioner to approach the civil Court and if the petitioner succeeds in the civil case, liberty is granted to the petitioner to approach the concerned Authority for getting electricity service connection.
5. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.
