O R D E R

The petitioner, who was arrested on 21.02.2024, for the offence punishable under Section 8(c), 22(c), 23(C), 28 and 29 of NDPS Act, 1985 in R.R. No.22 of 2024, registered on the file of the respondent, seeks bail.

2. According to the prosecution, the petitioner herein was arrested at Chennai Airport on 21.02.2024 for possession of 2790 grams of prohibited psychotropic substance and the chemical analysis report confirms the presence of Methaqualone and the final report was filed before the Principal Special Court for Exclusive Trial of Cases under NDPS Act, Chennai on 21.08.2024 and the trial is pending.

3. The learned counsel appearing for the petitioner seeks bail to the petitioner by citing long incarceration and the judgments of the Hon'ble Supreme Court which states that in case of prolong incarceration, bail can be granted despite embargo under Section 37(1)(b) of the EC and NDPS Act.

4. The learned Special Public Prosecutor appearing for the respondent submitted that, the contraband was seized in a public place i.e., in 2/4

Airport, where the petitioner herein, who is the citizen of Indonesia had smuggled commercial quantity of psychotropic substance into India from Laos via Singapore. He further submitted that if the petitioner is released on bail, there is every possibility of jumping bail.

5. Heard both sides and perused the materials available on record.

6. This Court on considering the rival submissions finds that this petitioner, who had found in possession of commercial quantity of psychotropic substance belongs to a foreign nation and release of this petitioner in bail will certainly hamper the trial, hence this Court is not inclined to grant bail to the petitioner.

7. Accordingly, this criminal original petition stands dismissed. 22.08.2025 stn 3/4
