Respondents Prayer: This Writ petition has been filed under Article 226 of Constitution of India, seeking a Writ of Certiorarified Mandamus to call for the records of the respondents in connection with the proceedings of the 5th respondent in O.M.U.9538/2001 and to quash the order dated 23.10.2002 made therein and consequently to direct the respondents to dispose of the application of the petitioner dated 01.09.2001 regarding classification of his patta lands as Odai Poramboke and Road Poramboke in accordance with law and after affording an opportunity to the petitioner.

O R D E R

The relief sought for in this writ petition is to call for the records of the respondents in connection with the proceedings of the 5th respondent in O.M.U.9538/2001 and to quash the order dated 23.10.2002 made therein and consequently to direct the respondents to dispose of the application of the petitioner dated 01.09.2001 regarding classification of his patta lands as Odai Poramboke and Road Poramboke in accordance with law and after affording an opportunity to the petitioner.

2. Heard both sides and perused the materials available on record.

3. Considering the facts and circumstances of the case, this Court is inclined to give direction to the respondents to dispose of the application of the petitioner dated 01.09.2001 regarding classification of his patta lands as Odai Poramboke and Road Poramboke in accordance with law and after affording an opportunity to the petitioner within a period of two weeks from the date of receipt of a copy of this order.

4. With the above direction, this writ petition is disposed of. Consequently, connected Miscellaneous petitions are closed. No costs.
