ORDER
The above writ petition has been filed seeking a mandamus to the third respondent to revoke the suspension order passed vide his proceedings in Rc.No.3055/2024/B dated 03.09.2024, and to reinstate the petitioner into service with all attendant benefits, by considering the representation dated 01.07.2025.
2. The petitioner, who had put in 12 years of service as the Village Administrative Officer in Peramium Village, Dharapuram Taluk, Tiruppur District, had been suspended by the third respondent vide his proceedings dated 03.09.2024, on account of the fact that he was arrested and detained in 2/6
prison for more than 24 hours.

The petitioner would contend that sometime in the year 2020, certain beneficiaries who were assigned with surplus lands, were issued with the ownership certificates by the petitioner and other revenue officials. The said assignment later came to cancelled on account of the fact that the said beneficiaries had created forged documents and encumbrances over the property. In the said case, the petitioner has been falsely implicated and he was arrayed as 6th respondent in Crime No.1 of 2020. The petitioner was arrested on 02.09.2024 and thereafter he was released on bail. On coming to know of the same, the third respondent had initiated action against the petitioner under Rule 17(2) of the Tamil Nadu Civil Services (Discipline and Appeal) Rules, 1955 and suspended him from service on 02.09.2024.
The petitioner would contend that till date no charge sheet or disciplinary proceedings was served on him. The petitioner had submitted his representation on 01.07.2025, to revoke his suspension order and to reinstate him service, but the same was not considered by the respondents to date. Hence, he is before this Court.
4. The petitioner would submit that since he was not served either with 3/6
charge memo or disciplinary proceedings, his suspension may be revoked and he may be reinstated into service. In support of his case, he relied on the judgment of the Hon'ble Supreme Court in Ajay Kumar Choudhry Vs Union of India reported in (2015) 7 SCC 291, and also has drawn reference to G.O.Ms.No.81, Human Resources Management (N) Department, dated 04.08.2022, wherein time limits were fixed for finalization of disciplinary proceedings.
5. Heard the learned counsel for the petitioner and the learned Additional Government Pleader who takes notice on behalf of the respondents.

Without going into the merits of the case, the writ petition is disposed of with a direction to the third respondent to consider the representation of the petitioner dated 01.07.2025, and shall pass speaking orders, in accordance with law, within a period of two months from the date of receipt of a copy of this order. No costs.
