The Managing Director v. A.Sudha

2022-11-09Honourable Mr Justice S. Sounthar1 pages

C.M.P.No.19015 of 2022 in C.R.P.No.3583 of 2022 S.SOUNTHAR,J.

In view of the fact that the surcharge order passed by the 1st respondent was already reversed by the Cooperative Tribunal, nothing survives in the stay petition and hence the stay petition is dismissed.

2. The learned counsel for the petitioner raised an objection that view of the order passed by the Cooperative Tribunal reversing the surcharge proceedings passed by the Deputy Registrar, there is a possibility that respondent may move the Deputy Registrar for raising of attachment. If any such application is filed by the respondent, it is always open to the petitioner to move to this Court for appropriate direction. Notice.
