The learned counsel appearing on behalf of the petitioner made a submission that the proposed petitioner is also a necessary party for the purpose of adjudication of the appeal suit.

2. The learned counsel appearing on behalf of the respondent opposed the contention by stating that the proposed petitioner should establish that he has got a legal right in respect of the suit schedule property.

However, these issues are to be adjudicated at the time of final hearing of the appeal suit. As far as the impleadment is concerned, the petitioner is also a necessary party.

Therefore, this Court is inclined to consider the impleadment petition.

Accordingly, the civil miscellaneous petition stands allowed. Registry is directed to carry out the necessary amendments.
