ORDER

This application has been filed to grant extension of Succession Certificate issued in O.P.No.199 of 2008 dated 05.09.2008 in favour of the applicant/petitioner with power to collect the securities and to receive the dividend and negotiate and transfer the securities specified in the Schedule.

Learned counsel for the petitioner would submit that while filing the original petition, the present Schedule shown list of Securities were omitted to be added which had now come to the knowledge of the petitioner. Hence, he seeks extension of certificate issued in O.P.No.199 of 2008 in favour of the petitioner on the certain terms of which, the succession certificate was issued.

3. Learned counsel for the respondent would submit that the respondents do not have any objection for the prayer being granted as sought for by the petitioner.

4. Even though the relief sought for in the application is to be granted to extend the Succession Certificate issued in O.P.No.199 of 2008 dated 05.09.2009, it is seen from records that the said Succession Certificate had been issued by the orders of this Court on 18.07.2008 and not on 05.09.2008. For that, learned counsel for the petitioner would submit that an inadvertent error had been crept in while drafting the petition.

5. Considering the averments made in the affidavit filed in support of this application and also taking into consideration that the respondents have no objection for granting the prayer, I am satisfied that the prayer sought for in the application can be ordered.

6. In view of the same, the application is ordered and the Succession Certificate issued by this Court in the instant O.P. dated 18.07.2008 is extended also to the Judges Summons mentioned in the schedule.

7.Registry is directed to include the Judge's Summons Schedule in the application to the Schedule in the order made in O.P.No.199 of 2008 dated 18.07.2008. 03-02-2025 msv
