Respondent Prayer:- Criminal Original Petition filed under Section 438 of the Code of Criminal Procedure, 1973 seeking to enlarge the petitioner on bail in the event of the arrest by the respondent police in Crime No. (Not-Known) of 2021 on the file of the respondent police. ORDER

The petitioner apprehend arrest at the hands of the respondent police for the offences punishable under Sections 420, 403 and 379 of I.P.C, in Crime No. Not known of 2021, seek anticipatory bail.

2. Today, when the matter is taken up for hearing, the learned Additional Public Prosecutor appearing for the respondent Police submitted that the petition enquiry is pending against the petitioner and they have not registered any case, as on date.

3. The learned Counsel for the petitioner submitted that the respondent police is harassing the petitioners under the guise of enquiry.

4. Considering the submissions made by the learned Additional Public Prosecutor appearing for the respondent, this Court passes the following order;

a) the petitioner shall appear before the respondent police daily at 10:30 a.m. and cooperate for the enquiry;

b) the respondent police is directed to conduct the enquiry and if any Cognizable offence has been made out against the petitioner, register the F.I.R or close the petition enquiry within a period of two weeks from today and report before this Court on or before 20.01.2022.

5. With the above directions, this Criminal Original Petition is disposed of. Post the matter on 20.01.2022 for reporting compliance. Till then, the petitioner shall not be arrested by the respondent police.
