This petition is filed under Section 378 (4) Cr.P.C., to grant leave to prefer an appeal against the judgment dated 14.08.2023 made in S.T.C.No.324 of 2021 on the file of the learned Judicial Magistrate II, Tiruchengode.

2. Heard Mr.J.Franklin, learned counsel for the petitioner.

3. Learned counsel for the petitioner contended that though the accused did not deny his signature on the cheque, the trial Court acquitted him on the ground that the complainant did not produce any witness to prove that he had lent a huge sum of Rs.10 lakhs to the accused and also did not produce the income tax returns.
