ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence under Sections 379, 430 of IPC and 21(1) of the Mines and Minerals (Development and Regulation) Act, 1957 in Crime No.1457 of 2021, seeks anticipatory bail.

2. The case of the prosecution is that the respondent police alleged against petitioner on the date 23.12.2021 trafficking the 3 units sand was carried without a proper permit. Hence the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.

4. The learned Additional Public Prosecutor submitted that the petitioner trafficking 3 units of sand in the lorry and 3 previous cases pending against the petitioner. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of this case, 3 previous cases pending against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
