ORDER
This Criminal Original Petition has been filed to call for the records in FIR No.205 of 2008 pending investigation on the file of the 1st respondent and quash the same.
2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the first respondent.
3. The petitioner is the second accused in the case; on the complaint given by the second respondent, a case has been registered in FIR No.205 of 2008 for the offence under Sections 420, 406 & 506(ii) I.P.C.
4. The learned counsel for the petitioner submitted that the petitioner who is the second accused, has got no involvement in the case; as against the petitioner, no material is available to make out the case.
5. The learned Additional Public Prosecutor submitted that so far as the petitioner / second accused is concerned, no allegation has been made against him and hence a fair investigation will be conducted and a final report will be filed shortly.
6. Since the matter is of the year 2008, the first respondent police is directed to complete the investigation and file a final report within a period of three weeks from the date of receipt of a copy of this order.
7. With the above observations, this Criminal Original Petition is disposed.
