The Petitioner, who apprehends arrest at the hands of the Respondent police for the offence punishable under Sections 25(1B)(a) of the Arms Act, 1959, in Crime No.255 of 2023 on the file of the Respondent police, seeks anticipatory bail.

2.The case of the prosecution is that on 30.06.2023 at about 01.30 pm, the Respondent police went the scene of occurrence and found a country gun in a two wheeler, without number plate. On investigation, they found that the Petitioner and other accused were involved in the commission of offence. Hence the complaint.

3.Learned counsel for the Petitioner would submit that the Petitioner is an innocent person. Based on the confession statement given by A1, this Petitioner was falsely implicated in this case. Hence, the learned counsel for the Petitioner seeks anticipatory bail to the Petitioner. 4.Learned Government Advocate (Crl. Side) would submit that the Petitioner already filed Crl.OP.No.18932 of 2023 before this Court for grant of 1/ 3

anticipatory bail and the same was dismissed on 25.08.2023. He vehemently opposed to grant anticipatory bail to the Petitioners. 5.Heard the learned counsel for the Petitioner and the learned Government Advocate (Crl. Side) appearing for the Respondent Police. 6.Taking into consideration the facts and the submissions made by the learned counsel on either sides and the fact that this Court already dismissed the anticipatory bail Petition filed by the Petitioner and there is no change of circumstances, I am not inclined to grant anticipatory bail to the Petitioner. 7.Accordingly, this Criminal Original Petition is dismissed. 26.09.2023 sai 2/ 3
