Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to stay all further proceedings in furtherance of the order in Na. Ka. No. 6153 / Ki2 / 2 / 2021 dt. 15.12.2021 issued by the 1st Respondent (WMP. 29699/2021), pending writ petition WP.28114/2021 and;
ii)To direct the 1st respondent, to restore the electricity connection to the Aavin Parlour with party Code 000006 situated in the campus of Tamilnadu ESI Hospital (WMP. 29702/2021), pending writ petition WP.28114/2021.
Order : This miscellaneous petitions coming on this day for hearing upon perusing the petitions and the affidavits filed in support thereof and upon hearing the arguments of MR.R.SREERANGAN, Advocate for the petitioner in both the petitions and of MR.P.GURUNATHAN, Additional Government Pleader on behalf of the Respondents in both the petitions ,the court made the following order:- W.M.P.No.29699 of 2021 has been filed seeking to stay all further proceedings in furtherance of the order in Na.Ka.No.6153/Ki2/ 2/2021 dated 15.12.2021 issued by the first respondent pending writ petition.
2.W.M.P.No.29702 of 2021 has been filed seeking to direct the first respondent to restore the electricity connection to the Aavin Parlour with Party Code 000006 situated in the campus of Tamilnadu ESI Hospital, pending writ petition.
3.It is represented by the learned counsel appearing for the petitioner that the petitioner is a widow running Aavin Parlour in the premises of the respondents from the year 2012 and without issuing any notice, the first respondent vide order dated 15.12.2021 unilaterally enhanced the rent amount and for non payment of the enhanced rent amount, the first respondent itself disconnected the electricity service connection, which is un-just in law.
4.Mr.P.Gurunathan, learned Additional Government Pleader takes notice on behalf of the respondents.
5.Considering the submission made by the learned counsel appearing for the petitioner, there shall be an order of interim stay, staying all further proceedings in furtherance of the order in Na.Ka.No.6153/Ki2/2/2021 dated 15.12.2021 issued by the first respondent pending disposal of the writ petition and there shall be an order of interim direction, directing the first respondent to restore the electricity connection to the Aavin Parlour with Party Code 000006 situated in the campus of Tamilnadu ESI Hospital, pending disposal of the writ petition.
