This petition has been filed to modify the condition imposed by this Court in para 9(ii) of the order dated 17.07.2023 in Crl.R.C.No.787 of 2023. 2.This Court, by order dated 17.07.2023 in Crl.R.C.No.787 of 2023 granted interim custody of the two wheeler 'Honda Activa' bearing Registration No.TN-09-CH-8424. One of the conditions was that petitioner to execute a bond for a sum of Rs.50,000/-.

3.This contention of the petitioner is that the order has been passed as early as on 17.07.2023. Since the Lower Court is insisting for property documents, the petitioner is unable to execute sureties and the vehicle is kept in the open yard, exposing to vagaries of weather and the purpose of having interim custody is defeated.

rsi for his daily avocation, considering the vehicle and its condition and year of purchase, this Court is inclined to modify the condition. Accordingly, the order dated 17.07.2023 made in Crl.R.C.No.787 of 2023 is modified to the effect that the petitioner shall execute a bond for a sum of Rs.5,000/- (Rupees Five Thousand Only).
