ORDER
The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 465, 467, 468 and 471 of IPC in Crime No.78 of 2025, registered on the file of the respondent police, seeks anticipatory bail.

The case of the prosecution is that, while the first petitioner worked as Surveyor of Pallavaram Taluk and the second petitioner worked as a Special Tahsildar of Pallavaram Taluk; that they colluded with other accused and involved in illegal mutation of the TSLR records by effacing the name of J.Vijayalakshmi and inserted the name of Chakkubai in S.No.356/9A of Keelkattalai Village, Boobathy Nagar, Chennai; and that they illegally issued fraudulent patta in TSR No.646 of 2018 dated 19.04.2018 in the name of Chakkubai to the property, which belongs to the defacto complainant; that thereafter the defacto complainant approached this Court vide W.P.No.21276 of 2021 challenging the issuance of fraudulent patta; that on the direction of this Court, preliminary enquiry was conducted and the petitioners herein are arrayed as accused in this case.

The learned counsel appearing for the petitioners submitted that the petitioners have been falsely implicated in this case and the predecessors of the petitioners had committed the offence of effacing the name in the TSLR records. He further submitted that the petitioners are ready to abide by any conditions that may be imposed by this Court and sought for anticipatory bail to the petitioners. 4.
The learned counsel for the intervener raised strong objection for the grant of anticipatory bail to the petitioners by stating that the petitioners are revenue officials, who colluded with other accused had fraudulently mutated the patta of the defacto complainant's property in the name of one late Chakkubai, who is the mother of co-accused in TSR No.646 of 2018; that the said Chakkubai was expired as early as on 08.04.1989, but the said patta was issued in her name on 19.04.2018; that further they also involved in manipulation of the original TSLR pertaining to the subject property by effacing the name of G.Vijayalakshmi and substituting the name of Chakkubai in the records, which came into light only during the course of preliminary investigation. 3/6

The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the anticipatory bail to the petitioners reiterated the prosecution case and stated that pursuant to the order of this Court in W.P.No.21276 of 2021, preliminary enquiry was conducted and the petitioners were arrayed as accused in this case; and that the investigation of this case is pending.

I have considered the submission made on both sides and perused the materials available on record.

Considering the facts and circumstances of the case, grave nature of offence and taking note of the fact that the investigation of this case is pending, this Court is not inclined to grant anticipatory bail to the petitioners.

Accordingly, this criminal original petition stands dismissed. Consequently, connected criminal miscellaneous petition stands closed. 07.10.2025 stn 4/6
