ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence under Sections 6(2)(3) TNCSC RDCS Order 1982 r/w 7(1)(a) of the Essential Commodities Act, 1955 in Crime No.183 of 2021, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner is having control of the ration shop of the Taluk Office, Nagapattinam. The ration goods will be supplied through the TNCSC godown situated at Panagudi Village which is nearby Nagapattinam Town. The petitioner maintaining the records properly including the stock register. The petitioner submits that the respondent police has seized a lorry nearby Velankanni illegally transporting the rice meant for PDS and that the vehicle originally belonged to Kerala State. Though the vehicle belonged to Kerala State, the number plate of the lorry reflected Tamilnadu Registration. The above factum of suppression was found by the general public and the matter was informed to the Velankanni Police Station and the police has arrested the driver and another person. Hence this case.

3. The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.

4. The learned Additional Public Prosecutor submitted that no previous case pending against the petitioner, all peoples are Kerala State. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of this case, all peoples are Kerala State, it needs detailed investigation, this Court is not inclined to grant anticipatory bail to the petitioner.
