This petition has been filed seeking to condone the delay of 79 days in filing the above C.R.P.

2. Mr.S.Vijayakumar, learned counsel for petitioner submitted that the petitioner was suffered with intermediant fever along with body pain and though his counsel informed him to collect the order copy for filing the Revision in time, but due to illness, he unable to meet his counsel and instruct him to proceed further and he was not able to file the Revision Petition in time. To that effect, he produced a medical certificate. In view of the same, there is a delay of 79 days arose in representing the above C.R.P. and the said delay caused is neither willful nor wanton, but for the above said reasons. Accordingly, he has filed the above petition.

3. Mr.A.K.R.Ravi, learned counsel for respondent appeared and submitted that he has no objection in allowing this petition.

4. Considering the facts and circumstances, and the reasons stated by the petitioner in the affidavit is justifiable one.
