PRAYER:
Writ Petition filed under Article 226 of the Constitution of India, praying to issue a writ of Certiorarified Mandamus, calling for the records of impugned order, dated 08.11.2021, Ref: Nil issued by the 5th respondent by nominating the 6th
respondent as President of Parent-Teacher Association of 5th Respondent school viz., Government High School, Naththahalli, Dharmapuri District and quash the same, consequently direct the 4th and 5th respondents to conduct the Parents Meeting for the nomination of President and other office bearers of Parents Teacher Association of the 5th Respondent School forthwith. ORDER
The petitioner challenges the appointment of R6 as President of the Parent Teachers Association of the 5th respondent Government High School, Naththhalli, Dharmapuri District.
2. Mr.Abishek Moorthy, learned Government Advocate who takes notice for the official respondents has sought time to get written instructions specifically in the light of the Government regulations, that require the President of the Parent Teachers Association to be either a parent or a guardian of the student who is studying in the educational institution concerned.
3. By proceedings in Na.Ka.No.118 of 2021, dated today (29.12.2021), R5, the Head Master of the Government School confirms that R6 is neither a parent nor a guardian of any of the children studying in the school. He also states that in view of the admitted irregularities in the appointment of R6, he will be removed forthwith and appropriate replacement will be made. Let the applicable regulations in this regard be adhered to scrupulously and the exercise completed as expeditiously as possible.
4. With the above observations and directions, this Writ Petition is disposed. No costs. Consequently, connected miscellaneous petitions are closed.
