Prayer : Writ Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the respondents in particular the fourth respondent to remove the blockage situated at the agricultural pathway situated at Survey No. 18/2 at Chidambarampatti Village, Sendamangalam Taluk, Namakkal District.

O R D E R

This writ petition has been filed for the issue of a writ of mandamus directing the respondents and in particular the 4th respondent to remove the blockage created by the private respondent and thereby preventing the petitioner from entering into his agricultural land.

2.Heard Mr.M.Saravana Kumar, learned counsel for the petitioner, Mr.A.Selvendran, learned Special Government Pleader for R1 to R6 and Mr.N.Manokaran, learned counsel for R7.

3.In the considered view of this Court, there is a private dispute between two co-owners. Such dispute cannot be resolved in a writ petition and the matter can only 2 / 4

be agitated before a competent Civil Court. By adding the official respondents, the petitioner has given an impression as if the official respondents have something to do with the private dispute between the petitioner and the 7th respondent. 4.There are absolutely no merits in this writ petition and accordingly this writ Petition stands dismissed. No costs. Consequently, connected miscellaneous petition is closed.
