O R D E R

The Criminal Original Petition has been filed seeking to quash the proceedings in C.C.No.529 of 2025, pending on the file of the learned Judicial Magistrate No.II, Puducherry.

2. Heard the learned counsel appearing for the petitioner and the learned Public Prosecutor (Puducherry) appearing for first respondent.

Based on the complaint lodged by the second respondent, Research Scholar at Pondicherry University, a case in Crime No.43 of 2015 came to be registered for the offence under Sections 509, 294(b) and 506(i) of IPC. As per the final report, the allegation against the accused is that on 31.07.2015, during the ongoing protest against the appointment of Vice Chancellor to the Pondicherry University, the petitioner insulted the de facto complainant, abused her in filthy language and also threatened her with dire consequences.

On perusal of the entire materials, it is seen that the incident occurred in the year 2015 during the alleged protest conducted against the appointment of the Vice Chancellor and still no progress has been made in this case and summons has not been served. Even if the entire materials collected are taken as proof, the same would not constitute the offence. Hence, continuation of such proceedings would be a burden not merely on the prosecution agency but also on the Court. 2/4

5. It is also relevant to note that a learned Single Judge of this Court, in a connected matter in Crl.O.P.No.19868 of 2023, related to the same issue, has already quashed a final report in respect of one of the accused.

6. Considering the above facts and circumstances of the case and the nature of allegations, this Court is inclined to quash the proceedings in C.C.No.529 of 2025.

7. Accordingly, the Criminal Original Petition is allowed. The proceedings in C.C.No.529 of 2025, pending on the file of the learned Judicial Magistrate No.II, Puducherry, is hereby quashed. Consequently, the connected miscellaneous petition is closed.
