For Intervener : M/S.J.E.R.LENIN, Advocate PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence under Section 420 of IPC in Crime No.128 of 2021, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner has projected himself as an advocate and cheated the defacto complainant. Hence the case.

3. The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He further submitted that the petitioner co-operated for the enquiry as per the direction given in this earlier order. 4. The learned Additional Public Prosecutor (P) submitted that one previous case pending against the petitioner. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. The learned counsel for the Intervenor raised objection stating that no other witness was examined by the Investigating Agency, if he released on bail tampering the evidence, he also took steps to alter the Section with regard to impersonation. He further submitted that some other persons created fabricated documents in order to grab the properties.

6. Considering the facts and circumstances of this case, that the petitioner is running the Welfare Association for Germany Community from the year 2015, under the guise of this association the petitioner indulge the law of any activities, the complaint pending before the CBCID, Puducherry, the complaint given by one Dayanithi, if he released on bail he is absconding and tamper the evidence, this Court is not inclined to grant anticipatory bail to the petitioner, interim bail is vacated.
