It appears that the Suit had been filed seeking permanent injunction against the 24th defendant from interfering with the possession of the plaintiff.
2.The father of the plaintiff had entered into an agreement with the 1st, 2nd and 3rd defendants to construct the suit schedule property. Thereafter, the plaintiff as the son had instituted a suit for partition. Naturally, the first foe of the plaintiff is his own brother. The brother had obtained an independent sale deed from the legal heirs of the 1st, 2nd and 3rd defendants. 3.It is stated that the 24th defendant is an employee of the brother. It is stated that therefore relief is sought seeking to protect possession. Some of the defendants are outside the jurisdiction of this Court. No substantial relief is sought against them. But since they are outside the jurisdiction of this Court, leave is sought. Since the property is within the jurisdiction of this Court, leave is granted. smv 4.It is to be noted that the 24th defendant had also filed caveat. While putting up further applications, the Registry may also put up a note whether the caveat is in force.
