C.M.P.No.4560 of 2023 in S.A.No.897 of 2002 V. LAKSHMINARAYANAN , J, This petition is filed to set aside the order of dismissal of the Second Appeal dated 26.11.2019 for default and to restore the above appeal.

2.I am satisfied with the reasons stated in the affidavit filed in support of this petition. Therefore, the order of dismissal of the Second Appeal for default is set aside and the Second Appeal is restored to file.

3.Post after three weeks for taking steps for R4 to R7. Private notice is also permitted.

4.The records in the Second Appeal has been sent back to the Lower Court as the appeal has already been dismissed for default.

Registry is directed to call for the records from the Lower Court immediately. Post after three weeks.
