Advocate (Crl. Side) For Intervenor : M/S.G.PALANI, Advocate PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence under Sections 419, 465, 467, 468, 471, 120B, 109 of IPC in Crime No.159 of 2021, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner is arrayed as Accused 10. The petitioner has not committed any offence as alleged in the FIR. The allegation mentioned in the FIR is totally false and foisted against the petitioner. Hence the case.
3. The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He further submitted that he is only the witness, apart from that he has not known anything as mentioned in the FIR. Hence, he prays for grant of anticipatory bail.

4. The learned Government Advocate (Crl.Side) submitted that there are 14 accused, A9 A11 are arrested, other accused still absconding. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.
5. The learned counsel for the Intervenor submits that he is a close relative of A9 / Marimuthu, who is the master mind to grab the property belongs to the defacto complainant which is worth about more than Rs.2 Crores. 3 sale deeds were created and pledged with Bank and obtain Bank loan more than Rs.78,00,000/-.
6. Considering the facts and circumstances of this case, still the investigation is in initial stage, if he released on bail he is absconding, this Court is not inclined to grant anticipatory bail to the petitioner.
