(Order of the Court was made by M.M.SUNDRESH,J.) This petition has been filed by the petitioner, who is the wife of the convict. She is the one who filed the main petition seeking a direction to the respondents for granting ordinary leave for the purpose of giving treatment to the son of the convict. However, now, the very same petitioner, who is the wife of the convict filed this petition to accept his surrender as his conduct is unbecoming of a father and husband.
2. The learned Additional Public Prosecutor also produced a report of the concerned officer, who accompanied the convict by way of escort sent by the Jail Superintendent.
3. On a perusal of the report, we find that the convict misbehaved and was not cooperating with the escort. There appears to be a serious dispute between the convict on the one hand and the petitioner and her son on the other.

4. In such view of the matter, we are of the view that it is only appropriate to direct the convict to surrender before the respondent/police on or before 30.09.2019 at 5.00 p.m.
5. With the above said direction, the miscellaneous petition is ordered accordingly.
