The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence under Section 6A and 7 of Cinematography Act in C.C. No.2336 of 2005 on the file of the learned XI Metropolitan Magistrate, Saidapet, Chennai, seeks anticipatory bail.

2. Learned counsel for the petitioner would submit that the petitioner has not committed any offence as alleged.

3. It is submitted by the learned Government Advocate (Crl.side) that this is a case of jumped bail, since he did not attend the Court on 02.08.2013 and hence, Non-Bailable Warrant was issued against the petitioner and the same is pending.

4.Considering the facts and circumstances of the case and considering the fact that Non-Bailable Warrant is pending against the petitioner herein, this Court is constrained to direct the petitioner to appear in person to file a petition under Section 70(ii) of Cr.P.C. for recalling the Non-Bailable Warrant before the learned Magistrate and in the event of filing such an application, the learned XI Metropolitan Magistrate, Saidpet, Chennai, is directed to consider the same, and pass orders on merits and in accordance with law on the same day.

With the above direction, the petition is disposed of.
