Petition filed under Section 24 of the Code of Civil Procedure to withdraw the O.P.No.4997 of 2023 pending on the file of the Principal Family Court, Chennai and to transfer the same to the IV Additional Family Court, Chennai where the M.C.No.315 of 2014 proceedings are pending to try with the same.

ORDER

The petitioner married the respondent on 14.09.2008. From the wedlock, a girl child was born 2010. She is aged about 14 years today.

2. The wife has already initiated M.C.No.315 of 2014 on the file of the IV Additional Family Court, Chennai. Thereafter, the petitioner has presented H.M.O.P.No.4997 of 2023 on the file of the Principal Judge, Family Court, Chennai.

3. Since the M.C.No.315 of 2014 is already pending for ten years, interests of justice requires and both the proceedings are tried together.

4. Mr.Chaithanya Prasad, learned counsel appearing for the wife has no objection for transferring the case and for both the proceedings to be tried together.

5. Accordingly, H.M.O.P.No.4997 of 2023 is withdrawn from the file of the Principal Family Court, Chennai and is transferred to the file of the IV Additional Family Court, Chennai. M.C.No.315 of 2014 and H.M.O.P.No.4997 of 2023 shall be heard together and disposed off as expeditiously as the exigencies of the Court's diary permits. This Transfer Civil Miscellaneous Petition is allowed. No costs. Consequently, the connected miscellaneous petition is closed.
