ORDER

The petitioner has come forward with this petition under Section 482 of Code of Criminal Procedure, seeking a direction to the first respondent to file a final report in Crime No.361 of 2007.

2. The learned counsel for the petitioner would submit that on the basis of the complaint given by the petitioner, a case has been registered in Crime No.361 of 2007 for the offences punishable under Sections 420, 465, 467, 468 r/w. 471 of I.P.C. However, the first respondent has not shown any interest to investigate the matter and lay a final report. Hence, the petitioner has come up with the present petition for the relief as stated above.

3. Learned Additional Public Prosecutor appearing for the first respondent would submit that the de-facto complainant is residing in Singapore and he is not co-operating for enquiry. He would also submit that if the de-facto complainant appears for enquiry, the respondent police were ready to file the final report. He further submitted that Accused No.3 died and Accused Nos.2 and 4 were already arrested.

4. Considering the averments made in the affidavit and also perusing the typed set of papers, the petitioner is directed to appear before the first respondent on any day. After his appearance, the first respondent is directed to complete the investigation in Crime No.361 of 2007 and file a final report, within a period of six months from the date of appearance of the petitioner.

5. The Criminal Original Petition is disposed of with the above direction.
