A. Manohar v. Geetha Lakshmi

2024-10-25Honourable Mr Justice V. Lakshminarayanan1 pages

C.M.P.No.23881 of 2024 in C.M.P.No.5606 of 2024 in in CRP.No.2353 of 2023 V.LAKSHMINARAYANAN, J.

Though the petitioner seeks for extension of time for six months, Mrs.R.Hemalatha for Mr.C.Prakasam appearing for the respondent points out that the evidence has been concluded and only arguments have to be made by the civil revision petitioner.

2. In the light of the fact that the trial has concluded and arguments alone have to be heard, the time fixed by this Court is extended for a further period of 15 days to enable the learned Judge to hear the arguments and pronounce the judgment in the proceedings.

3. At this stage, Mrs.Hemalatha points out that the maintenance has not been paid by the civil revision petitioner to the respondent and the child.

In such eventuality, it is always open to the respondent /wife to move an application to strike off the divorce petition for nonpayment of maintenance. I am sure, if such an application is filed, the learned Judge will decide the same on its own merits.
