The instant writ petition has been filed with a prayer for issuing a Mandamus to direct the fifth respondent to return the petitioner's original certificate and documents collected by the fifth respondent while admitting the petitioner to the post graduate degree course along with her post graduate degree certificate.

The learned counsel for the petitioner would submit that she joined the postgraduate course in 2020 and during the course, she availed maternity leave from 01.12.2021 to 31.07.2022, and after that, she completed the course on 31.01.2024. According to the bond executed by the petitioner, the bond 2/6
service was for a period of two years, whereas by virtue of G.O.Ms.351, Health and Family Welfare (MCA-1) Department dated 27.10.2023, it was reduced to one year. Therefore, the bond period of the petitioner ends on 31.01.2025. Until now, no posting order has been issued. Hence, he would submit that the petitioner is entitled to the return of all original certificates.
3. The said contention was stoutly objected by the learned Government Advocate appearing for the respondents, and would contend that the posting order had already been issued on 26.05.2025. He would further submit that the petitioner approached this Court only after the issuance of the posting order. Therefore, the petitioner has to undergo the bond period.
4. I have given my anxious consideration to either side submissions.

While looking at the facts of the case, it is not in serious dispute that the bond period for the petitioner is only for one year by virtue of G.O.Ms.351, Health and Family Welfare (MCA-1) Department dated 27.10.2023, and it is also not in dispute that the bond period of the petitioner ends on 31.01.2025, as per the prospectus and Government Order. Therefore, 3/6
apparently, as per the judgment of the Hon'ble Division Bench of this Court in the case of State of Tamil Nadu Vs. P.S.Sairam and Others (W.A.No.799 of 2019, etc.), the petitioner is entitled for the return of original certificates, as the posting order is subsequent to the completion of the bond period.
6. In view of the above, this Court deems it appropriate to direct the fifth respondent to return all original certificates of the petitioner within a period of two weeks from the date of receipt of a copy of this order.
7. In the result, this Writ Petition is disposed of with the above directions. Consequently, the connected Miscellaneous Petition is closed. No costs.
