This writ petition has been filed seeking issuance of Writ of Certiorarified Mandamus calling for the records pertaining to the impugned summons dated 12.10.2022 in Case No. 2333 of 2022 on the file of the respondent, and quash the same, consequently directing the respondent to furnish details along with a copy of the complaint pertaining to the petitioner.
2.The learned Senior Counsel appearing for the petitioner submitted that immediately on receipt of the impugned summons, the petitioner approached the respondent seeking to furnish details along with a copy of the complaint pertaining to the petitioner inorder to effectively adjudicate before the respondent, however, the same was not furnished to the petitioner. Hence, this Court, without going into the merits of the case, may issue direction to the respondent to furnish details along with a copy of the complaint pertaining to the petitioner inorder to enable the petitioner to effectively participate in the enquiry. 3.In response, the learned Special Government Pleader appearing for the respondent submitted that the copy of the complaint and other details pertaining to the petitioner, will be forwarded to the 2/4
petitioner.
4.Considering the limited request now made by the learned Senior Counsel appearing for the petitioner, this Court, without expressing any opinion on the merits of the case, directs the respondent to furnish copy of the complaint and other details pertaining to the petitioner, to the petitioner so as to enable the petitioner to effectively participate in the enquiry. This Court further directs that the enquiry against the petitioner shall be completed within a period of twelve weeks from the date of receipt of a copy of this order.
5.The writ petition is disposed of with the above observation. No costs.
