This criminal original petition has been filed for a direction to the respondent to send for the settlement deeds dated 15.09.1962 registered as document No.2933/1962, which were seized, pursuant to the cognizance taken by the learned Metropolitan Magistrate for CCB/CBCID Cases, Egmore, Chennai, in C.C.No.5262/2023, to the Forensic Department, to compare the same with the admitted signature of other documents.

2. Heard both sides and perused the materials placed on record.

3. The petitioners are accused in C.C.No.5262/2023. Initially, on the complaint lodged by the complainant, the respondent registered an FIR in crime No.463/2006 and on completion of the investigation, the respondent filed a final report before the learned Metropolitan Magistrate for CCB/CBCID Cases, Egmore, Chennai. While pending investigation, the petitioners filed Crl.O.P. No.18638/2020 for a direction to the respondent to send for the said documents for getting handwriting expert opinion. This Court, by order dated 08.06.2022, directed the respondents to get handwriting expert opinion on the aforesaid documents.

4. After completion of investigation, the respondent filed final report and 2/4

the same has been now taken cognizance by the learned Metropolitan Magistrate for CCB CBCID Cases, Egmore, Chennai. Therefore, the petitioners can directly approach the learned Metropolitan Magistrate for CCB CBCID Cases, Egmore, Chennai, for appropriate relief. With the above observation, this Criminal Original Petition is disposed of.
