Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, for issuance of Writ of Mandamus, directing the 1st respondent to consider the representation of the petitioner dated 10.09.2023 in accordance with law by holding enquiry under 151 of PSO Act in to excesses committed by the 2nd respondent by demanding Rs.3,80,000/- or equivalent Gold and also return of Memory Card of CCTV footage of R.Gold shop at Tirupur, Tirupur District.

ORDER

The petition has been filed a direction directing the 1st respondent to consider the representation of the petitioner dated 10.09.2023 in accordance with law by holding enquiry under 151 of PSO Act in to excesses committed by the 2nd respondent by demanding Rs.3,80,000/- or equivalent Gold and also return of Memory Card of CCTV footage of R.Gold shop at Tirupur, Tirupur District.

2. On perusal of the counter filed by the second respondent, no such action has been taken as alleged in the said representation.

3. The learned counsel for the petitioner submitted that the allegation itself is as against the second respondent and as such, he cannot be a judge for his own case. In view of the above, the first respondent is directed to appoint an Investigation Officer not below the rank of Assistant Commissioner, to conduct an enquiry on the complaint lodged by the petitioner after issuance of notice to the petitioner and dispose of the same within a period of twelve (12) weeks from the date of receipt of the copy of the order.

4. With the above directions, this Writ Petition is disposed of. No costs.
