This petition is filed to condone the delay of 30 days in preferring the above Criminal Appeal.

2.The petitioner filed a private complaint against the respondent under Section 138 of the Negotiable Instruments Act in S.T.C.No.59 of 2018. The learned Judicial Magistrate No.II, Bhavani, by judgment dated 06.03.2024, dismissed the complaint acquitting the respondent, against which, the petitioner filed the present appeal with a delay of 30 days. The delay is occurred due to applying for certified copy, receiving the same and thereafter contacting his counsel at Chennai.

3.Mr.V.Vijayakumar, learned counsel appearing for the respondent submitted that the reasons given for the delay is not proper. Hence, strongly opposed the petition.

rsi 4.It is seen that the reasons given by the petitioner seems to be acceptable and the petitioner has got right for an appeal. The contention of the respondent on the merits of the case can be considered at the time of admission.

5.In view of the same, the delay stands condoned and the petition is ordered.
