By consent of both the learned counsel for the parties, the Writ Petition is taken up for final disposal, at the admission stage itself.

2. The instant writ petition has been filed with a prayer for issuing a Mandamus, directing the respondents to consider the representation, dated 03.07.2025 and further direct the 3rd respondent to fix the salary as per the Rule 18 of the PRERA (R&D) (General) Rules, 2017, equivalent to the "last drawn salary".

3. Heard the learned counsel for both sides and perused the materials available on record.

4. The learned counsel for the petitioner would submit that the petitioner was appointed as President of the District Consumer Disputes Redressal Forum, Puducherry in the year 2004 by the Government of 2/6

Puducherry and he relieved from the post of President of the Office of the State Commission and District Forum, Puducherry on 25.09.2018. Thereafter, he has given a representation to the Chairperson, PRERA, Puducherry on 23.01.2024 claiming his pay in accordance with the Second Notional Judicial Pay Commission and such representation is pending before them. It is the further submission of the petitioner that again he sent a representation to the 3rd respondent on 03.07.2025 and such representation is also pending with them. It is the submission of the petitioner that his representation has to be considered in accordance with Rule 18(1) of the Puducherry Real Estate (Regulation and Development) (General) Rules, 2017. The learned counsel for the petitioner would also submit that his last drawn pay is Rs.2,09,118/-.

5. At this juncture, the learned Additional Government Pleader (Pondicherry) appearing for the respondents would submit that they will consider the petitioner's representation according to it's own merits and in accordance with law, within a reasonable time.

6. In such view of the submission, without going into the merits of the writ petition, this Court deems it appropriate to direct the 3rd respondent to 3/6

consider the petitioner's representation dated 03.07.2025 and pass orders on it's own merits and in accordance with law, within a period of six weeks from the date of receipt of copy of this order.

7. With the above direction, the Writ Petition is disposed of. No costs. 08.08.2025 Index : Yes/No Speaking order /Non Speaking Order dm 4/6
